MINUTES <br />City Counci <br />October 14, <br />1 <br />1981 <br />Mrs. Nardini stated that perhaps Mr. Rosauer was better off to leave <br />the property as is. <br />The Attorney stated that the City does not have the right to deny <br />someone to split their property just because the other lot would not <br />have road access. It is not the City's duty to protect buyers. <br />The City would not have to issue a building permit for the lot. <br />Mr. Forsberg asked where the City would get the additional 17 feet <br />needed for road access. The Engineer stated that the City could get <br />this footage as the other properties in the area develop. <br />The Planner also pointed out that he is recommending a turn - around <br />at the end of the dedicated easement. <br />Mrs. Scalze commented that she would be in favor of calling Parcel A <br />an outlot, as then no building permit could be issued. <br />Mr. Forsberg asked Mr. Rosauer if he agreed with dedicating additional <br />property for a cul -de -sac at the end of the street. Mr. Rosauer stated <br />that he did not. <br />The Planner stated that if the City does approve this division it should <br />be noted that no building permit will be issued until such time as a <br />City approved street is put in. The Planner also suggested that this <br />be recorded with the Register of Deeds. The Planner also stated that <br />when a building permit is applied for, a turn - around should also be <br />provided that would provide access to the property on the north of the <br />Rosauer property. <br />The Planner stated that he would sketch the cul -de -sac in on the City's <br />plans for the records. <br />Mr. Forsberg commented that the road should have been dedicated through <br />to the Westwinds at the time the Westwinds plat was approved. <br />The Attorney informed Mr. Rosauer not to bring his abstract up -to -date <br />until the Council's resolution is filed with the County Recorder. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 81 -10 -604 - APPROVING THE ROSAUER PROPERTY <br />DIVISION OF PARCEL A AND DECLARING THAT PARCEL A SHOULD BE <br />RECORDED WITH THE COUNTY RECORDER'S OFFICE STATING THAT <br />NO BUILDING PERMIT WILL BE ISSUED FOR THIS PARCEL UNTIL <br />SUCH TIME AS SATISFACTORY ROAD ACCESS HAS BEEN ACQUIRED <br />AND PROVISIONS MADE FOR A CUL DE SAC AT THE END OF THIS <br />STREET • <br />The foregoing resolution was duly seconded by Mr. Hanson. <br />Ayes (4) Scalze, Hanson, Nardini, Forsberg. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 392. <br />Page -5- <br />
