First of all, Minnesota Department of Transportation, District 9, is responsible <br />for the design of this stretch of Rice Street, since it is a State Highway. <br />At our request, the District 9 office conducted a preliminary review of this <br />potential permit request. This request was routed through every relevant <br />department, being reviewed in accordance with the future plans for the <br />up- grading of this roadway. Enclosed is a copy of a letter from Mr. Donald <br />Fashant, Roadway Regulations Supervisor. As you will see, the MnDot staff <br />sees no problems in approving the development of this access at this time, <br />provided that it is limited to a right turn in and out movement. They also <br />noted that when the roadway is up- graded, a full turning movement could be <br />safely accommodated. <br />To further assist us in forming our opinion about this matter, we retained the <br />services of the Benshoof & Associates transportation planning firm. Also <br />enclosed is a copy of Jim Benshoof's report. You will also note in reviewing <br />Mr. Benshoof's report, they have concluded that this access could be developed <br />with no adverse impacts upon traffic movements along Rice Street. In fact, <br />their analysis indicates that this solution will have a favorable effect on <br />traffic on Minnesota Avenue. <br />In summary, our review of this proposed access, as well as the reviews of <br />transportation planners and engineers from both the Minnesota Department of <br />Transportation and a consulting firm, leads us to believe that it can be <br />developed and function well. This access point has a very direct relationship <br />to the value of this land for development. We have advised Mr. Schroeder to <br />resist the taking of this access, unless someone can provide us with compelling <br />reasons to do so.
