ATTACHMENT #8 <br />IliaRIG if .ASSO(I#TtS <br />Memo <br />TO: Honorable Mayor & City Council Members <br />FROM: Lee Elfering, City Engineer <br />DATE: March 22, 2013 <br />RE: 33' Road Easement Vacation <br />Pinetree Ponds Development <br />The road easement in question was originally granted on 7/18/68 when the area north of <br />Labore Road was largely unimproved. The 33 foot width would have made up half of the <br />standard 66 -foot street right -of -way width that was typical at that time. It is likely the <br />intent was to require the other half of the right -of -way (33 -feet) to be dedicated from the <br />other adjacent property owners. Since the time of the original dedication, extensive <br />development has occurred in the area to the north with the improvement and extension <br />of the City's street network, watermain, sanitary sewer, and storm sewer facilities without <br />the use of this easement. There has also not been any additional road easement or <br />right -of -way granted from any adjacent properties since the original dedication to <br />complete the required width for a street which has decreased from 66 -feet to 50 -feet. <br />The proposed Pinetree Pond development incorporates three of the properties that could <br />benefit from the use of this road easement. As the development is laid out a new street <br />right -of -way is being granted that aligns with Cherry Hill Lane at Labore Road. This <br />connection point is preferred to the existing road easement location because it provides <br />for a full intersection at Labore Road instead of offset intersections. Also provided by the <br />Developer was a ghost plat of the area to the northwest of the plat encompassing the <br />back yard areas of the properties at 2971, 2981, and 3001 Labore Road. Street right -of- <br />way is being dedicated to the boundary of the Pinetree Ponds development based on a <br />road alignment similar to that of the ghost plat to allow service of the area to the <br />northwest with street and utility improvements. <br />There have been other layouts proposed for development of the area to the northwest <br />that were preferred by at least one of the adjacent property owners. One of these <br />options was to extend a street from the proposed circle turnaround in Pinetree Pond to <br />the east. This layout would provide for more immediate development potential for one <br />adjacent property but is not acceptable to the Developer of the Pinetree Ponds plat. He <br />believes this layout would negatively affect the marketability of the lots and therefore <br />would not proceed with the development with this alternate layout. A second alternative <br />was also provided by the adjacent property owners utilizing the existing road easement <br />and the connection point proposed by the developer.
