TO: Little Canada Planning Commission FROM: Stephen Grittman DATE: 12 November 1986 RE: Cellular One Conditional Use Permit FILE NO: 758.09 - 86.36 BACKGROUND Mr. Philip Oxley has applied for a conditional use permit on behalf of Cellular One. The purpose of the CUP is to allow the construction of transmitting facilities on property located at 53 South Owasso Boulevard. The site is zoned I Light Industrial, and is a portion of the Donovan Construction Company property. ANALYSIS Cellular One is a mobile telephone company which is regulated by the FCC and the Minnesota Public Utilities Commission. Concurrent with this CUP application is a text amendment allowing facilities such as these as conditional uses. The criteria for conditional use evaluation are listed in the text amendment analysis. The site is located within an industrially zoned area and complies with the CUP intent. One problem has become apparent with the submission of the site plan. The site has no street frontage and the addition of the telephone facility would constitute a second principal use. This may require the use of a Planned Unit Development or possibly a subdivision. The lack of street frontage, however, brings up another issue. In 1984, the City Council required that the property owners in this area dedicate and improve, at least with a gravel surface, a road along the railroad to provide emergency vehicle access to the properties which would be isolated during the periods when a train is using the track. In addition, the Council required that the road be improved to City standards, including paving, curb and gutter prior to any building being allowed in the area.
