ORDINANCE NO. <br />AN ORDINANCE AMENDING THE LITTLE CANADA CODE BY <br />ADDING A NEW CHAPTER 2201. UNDERGROUND INSTALLATION <br />OF NEW UTILITY LINES. <br />THE COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. Thatthe Municipal Code of Little Canada is hereby amended by <br />adding a new Chapter 2201. 'Underground Installation of New Utility Lines, to read <br />as follows: <br />"2201. UNDERGROUND INSTALLATION OF NEW UTILITY LINES. <br />2201.010. PURPOSE. This ordinance is enacted to provide for orderly, <br />economic and safe development of land and urban services and facilities, and to <br />promote the public health, safety and general welfare of the inhabitants of the <br />City of Little Canada. <br />2201.020. UNDERGROUND INSTALLATION OF NEW UTILITY LINES. All new <br />electric distribution lines (excluding main line feeders and high voltage transmission <br />lines), CATV lines, telephone service lines and other services constructed and <br />providing service to customers shall be buried underground. These regulations shall <br />apply to all new land development proposals in the City including, but not limited <br />to, new subdivision, apartments,,nonresidential buildings, planned unit developments, <br />and single family dwellings. <br />The developer is responsible for complying with these regulations and shall <br />submit with his application for final plat or site plan approval, a written statement <br />from the utility companies that the necessary arrangements for the underground <br />installation of utilities have been made and associated easements incorporated into <br />the plat. <br />It shall be the responsibility of the developer and all contractors involved <br />in construction to establish and maintain grade within utility easements to within <br />six (6) inches of final grade and to keep utility easements free and clear, to the <br />end that the utility company shall have access at all times for installation and <br />maintenance of its utilities. <br />This ordinance applies to public utility lines designed and constructed <br />to distribute utility services to customers in the City, but does not require under- <br />ground installation of appurtenant facilities such as lift stations, fire hydrants, <br />meters, transformers, pedestals, and the like. <br />2201.030. EXCAVATION. In the interest of public safety and to avoid <br />possible damage to underground utilities, no person, firm or corporate body shall <br />excavate in any easement or right -of -way containing underground utilities without <br />first notifying the utility company, or companies, whose lines occupy the easement <br />or right -of -way; provided however, such excavation shall not constitute a breach of <br />this ordinance unless the excavator has actual notice of the existence of the utilities <br />or unless the easement has been recorded with the Register of Deeds of Ramsey County <br />with reference to the property. <br />000.1.0 <br />
