September 8, 1977 <br />TO: City Council <br />Little Canada, Minnesota 55110 <br />SUBJECT: Request for variance due to hardship imposed by easement.° <br />RE: Lot #110 -15 at 3298 Twin Lake Road <br />I have just discovered that my property which I had thought was four lots has had <br />two easements taken against it to an extent or greater that I had known about. I <br />had believed this property to have a west boundary of 137.5 feet running east on <br />the north boundary for a 165 feet going north again for 40 feet continuing east <br />for 100 feet then south for 177.5 feet then west for 265 feet. This belief was <br />confirmed as late as June, 1976 by an updated abstract title and legal description <br />verified by your records. <br />I now desire to subdivide this land into three lots only to be informed that ease- <br />ments have been taken against my property that would prohibit such subdivision if <br />such subdivision was in full compliance with the city codes. <br />Further justification of my right to believe the land and the legal description was <br />in fact all mine are the following facts; <br />1. I have not been informed of any road easement being taken against my property <br />to the extent indicated by your plot map. <br />2. Twin Lake Road,at present, on neither the east or south boundaries of my <br />property is more than two lanes wide. <br />3. There are no surveyor stakes or any other indication of a road easement. <br />4. I believe I am taxed on the full legal description of my property. <br />5. The City has performed no care or maintenance on any of the property in <br />question and in fact has been left completely in my care. <br />6. The sewer line installed by the village has four outlets into my property - <br />three along the south boundary and one along the west boundary. <br />7. I have not been reimbursed of any property under condemnation proceedings <br />or any other proceedings that would legally deprive me of full rights and <br />enjoyment of this property without due process of law that was guaranteed <br />me by the Constitution of the United States. (Such deprivation may be <br />difficult to acquire since subject easement is only on the north side of <br />the street along my southern boundary not equally on both sides of the <br />street.) <br />Due to the arbitrary nature of the alleged easements, I have been caused to suffer <br />not just the loss of property and the time and money spent in the upkeep of <br />property legally mine but extreme mental anguish and torment by the anything but <br />above -board tactics used by the City in their attempts to confiscate my land. Also, <br />to the best of my knowledge and belief the City has published no plans nor notice to <br />utilize this land. <br />0006 <br />
