Johnson 324 Sextant Little Canada, Minnesota 55117 September 14, 1978 RE: FILL IN UNNAMED WETLAND, RAMSEY COUNTY CERTIFIED Dear Mr. Johnson: It has been reported to this office by a DNR officer that you have placed fill material on the bed of an unnamed wetland abutting your property within the SW1 SW'/ of Section 5 and the SE' SE' of Section 6, T.29N, R.22W, Ramsey County. The subject water body is considered to be public waters of the State of Minne- sota and thus any activity which changes the cross- section of such a water basin requires a permit from this department pursuant to M.S. 105.42. Your action was not authorized by the DNR and therefore constitutes a misdemeanor, punishable by up to $500 in fines and 90 days in jail. Since existing regulations do not allow the department to allow filling of public waters for the purpose of creating building sites, the fill must be removed and the basin restored to its original cross- section. We are allowing you thirty days from receipt of this letter to accomplish this. If you fail to act within the specified time period, we will have no other recourse but to pursue additional legal action to insure that the material is removed. Also, any additional filling after date of receipt will be considered to be separate violations of M.S. 105.42 and handled accordingly. No fill material shall be attempted to be removed unless an authorized DNR agent is present at the site to supervise the operation. Please notify this office 48 hours in advance of conducting the work so that arrangements can be made to have an inspector on site. You can reach me at 296 -7523.
