CITY OF LITTLE CANADA <br />VARIANCE REQUEST <br />TIME SCHEDULE AND REVIEW PROCESS <br />A. The applicant files request with accompanying fee at least ten days prior to <br />the next regular Planning Commission meeting at which the request is to be <br />considered. <br />B. Where appropriate, the City Clerk and appropriate staff will meet with the <br />applicant to discuss the request and related information. <br />C. The City Clerk shall forward the request and supportive information to the <br />Planning Commission no later than seven days prior to the meeting at which <br />the matter is to be discussed. <br />D. Planning Commission acknowledges filing and receipt of the application, <br />reviews the request, evaluates whether any technical response or investigation <br />is required from staff or other concerned commissions or units of government. <br />The Planning Commission may table further discussion of the request until such <br />time as questions are resolved. In such cases, a specific date shall be set for <br />the continuation of the discussion. Upon final review of the matter, the Planning <br />Commission shall forward its recommendation to the City Council . This <br />recommendation shall be made no later than sixty (60) days following the <br />Planning Commission meeting at which the request was received. <br />E. The City Council reviews the Planning Commission recommendations, etc., <br />requests any additional necessary information and sets a public hearing. <br />F. The City Council holds the public hearing and reviews all public comment. <br />If all requested information has been submitted, a finding of fact and a <br />decision of approval /denial is determined. <br />G. Should the Council's decision be a reversal of the Planning Commission recom- <br />mendation, the request shall be referred back to the Commission with an <br />explanation as to the basis for the Council's decision. The Commission will <br />then re- evaluate the matter at their next regular meeting. If appropriate, the <br />Commission will respond again to the Council on the request. <br />H. If the Council's decision coincides with that of the Planning Commission or <br />at the next meeting following the Commission's reconsideration of the request <br />the Council shall take final action on the matter. The City Council's decision <br />will be made within sixty (60) days following the meeting date at which the <br />request was first received by the Council . The City Clerk notifies the applicant <br />in writing of the City Council's decision. <br />19 <br />
