Parks:
CITY OF
LITTLE CANADA
3eferring to your letter of November 10, 1978, I would like to
note several discrepencies in the facts that were related to you.
Gn August 23, 1978 I inspected the damage, along with Mr. Homer
Dole at his residence, 672 LaBore Road, Little Canada, Minnesota.
Nr. Dole stated to me at that time that the collapse of the basement
wall on the north side of his home was caused by Centerrial Contractors
vibrating equipment used to compact the road prior to surfacing it.
1 was with Mr. Dole that afternoon and at no time did he mentioned
anything about surface water runoff causing this loss.
If you have taken the time to inspect Mr. Dole's property you will
note that it is approximately 3 feet lower than the surface road
level and sits on a very steeply inclined lot with a walkout on the
back side of the basement. This is an ideal situation for surface
water runoff, causing collapse of the basement.
Also, I am sure Mr. Dole's basement may have had cracks, being close
to a busy road which occured over a period of years. With this heavy
surface runoff not necessarily being aided and abetted by our insured.
The basement on the north side simply collapsed sue to hydrostatic
pressure.
Our insured's engineer, Ewald Biese of Carle Engineering inspected thi
runoff problem after the incident and instructed Maynard Tebin, our
DULUTH OFFICE
728 CAST SUPERIOR
55802
21E-727-8731
FARIBAULT OFFICE
POST OFFICE BOX 33
55021
507 - 334 -5672
