Date of Occurrence: <br />October 27, 1978 <br />351 -L- 636844 <br />City of Little Canada <br />Betty Boysen <br />6/30/78 <br />Please be advised that we are the liability insurance carriers <br />for the City of Little Canada. As liability insurance car- <br />riers for them, it is our duty not to pay all claims, but <br />those to which our insured shows to be negligent, and there- <br />fore, legally liable. <br />Our investigation <br />into that the <br />issanitary sewer line which <br />strictly owned by the <br />Metropolitan Waste Control Commission. It was revealed to <br />us that it is the City of Little Canada's responsibility to <br />maintain this sanitary sewer line within the city limits. <br />It has been proven that the sanitary sewer line within the <br />insured's jurisdiction was properly maintained. There were <br />found to be no defects in this line within the limits. Also, <br />it is obvious that the city would have no control over the <br />unusually extensive rains which fell on June 30, 1978. <br />With these above facts clearly in mind, we must respectfully <br />decline to make any payment towards your claim. If you have <br />any questions concerning our above decision, please feel free <br />to contact the undersigned.
