Our Claim Number: 351 -L- 636844 b. Insured: City of Little Canada c. Claimant: Carl Carlson d. Date of Occurrence: 6/30/78 Please be advised that we are the liability insurance carriers for the City of Little Canada. As liability insurance car- riers for them, it is our duty not to pay all claims, but those to which our insured shows to be negligent, and there- fore, legally liable. Our investigation reveals that the sanitary sewer line which brought the water into your home 1s strictly owned by the Metropolitan Waste Control Commission. It was revealed to us that it is the City of Little Canada's responsibility to maintain this sanitary sewer line within the city limits. It has been proven that the sanitary sewer line within the insured's jurisdiction was properly maintained. There were found to be no defects in this line within the limits. Also, it is obvious that the city would have no control over the unusually extensive rains which fell on June 30, 1978. With these above facts clearly in mind, we must respectfully decline to make any payment towards your claim.
