Mr. and Mrs. Zoch's property lies next to property owned by you. Your property lies to the west of the Zoch's property. We have observed that some time in the past you excavated con- siderable fill from your property making it 20 to 30 feet lower than the Zoch's adjacent land. The grade between the two properties appears to be illegal in that it is almost vertical. Over the past few years and especially during 1978 the heavy rains have caused serious erosion resulting in gullys which are encroaching upon the Zoch property. In short, your use of your property has deprived the Zoch's of their right of lateral subjacent support which they are entitled to from you as an adjacent contiguous landowner. The purpose of this letter is to advise you of this condition and to request that you take immediate remedial action to prevent further property loss to the Zoch property. At its present stage we believe the matter can be handled simply without undue expense or complication. Your intentions regarding the situation are solicited.
