MINUTES <br />CITY COUNCIL <br />FEBRUARY 8, 2006 <br />Keis stated that he did noC have a problem with people using Cheir yards. <br />Keis stated thaC the difference here is Che addition of a permanent sports <br />com•t in the front yard versus the back yard. <br />Pechman stated that he would not object to the sports court if it were in the <br />back yard. <br />Montour noted that people have basketball hoops over their garages <br />playing basketball in front yards. He also noted that people play hockey in <br />driveways. Montour asked how the City is supposed to regulate this type <br />of recreational use in the front yard. <br />Allan noted that a basketball hoop on a garage does not completely change <br />the look of the fronC yard. Montour pointed out that there is still a noise <br />factor. <br />Pechman stated that there are neighbors with basketball hoops, and agreed <br />there is noise. He noted, however, that the Galba's are proposing a sports <br />court. He also pointed out that the landscaping that is in place as well as <br />what is proposed will not provide screening for this court for many years. <br />Keis stated that he does not have a problem with recreational uses such as <br />tennis courts, hockey rinks, skate board ramps, etc., and felt that this was <br />part of living in a neighborhood. Keis stated that the problem for him is <br />the location, indicating ChaC he is opposed to this use in the front yard. <br />Kimmes felt that the issue of a sports courC in the fronC yard and a <br />basketball hoop over a garage were two different worlds. Kimmes felt <br />that the City should not deny people the opportunity to have a sports court <br />in the back yard, but he opposed this use in the front yard. Kimmes felt <br />the Council has a responsibility to Che City's residents to say no to this use <br />in the front yard. <br />Matt Galba indicated that he was initially told to stop work on the sports <br />court, but then was told it was O.K. to proceed. He was again told to stop, <br />but stated that he continued on because he had the materials and the matter <br />appeared to be unclear. Stephanie Galba reported that he ca]led the City <br />Planner and was told that they could have a hockey rink in their front yard. <br />After learning that the Mayor had complained about the court, Galba <br />indicated that she called him to discuss the matter at which Cime he <br />apologized. <br />Blesener reported that he initially withdrew his complaint after Stephanie <br />Galba informed him that the City Planner had indicated the use was <br />allowed. Upon further research, he learned that the sports court was not <br />allowed. <br />10 <br />
