MINUTT/S <br />CITY COUNCIL <br />P'}JBRUARY 8, 2006 <br />Stephanie Galba suggested that perhaps they should have stopped work on <br />the sports court. However, they never received a straight answer from <br />anyone. Blesener pointed ouC that the City told the Galba's to stop <br />construction on several occasions. Allan pointed out that the Galba's <br />received three letters from the City telling them to stop construction on the <br />sports court. <br />The City Administrator noted that letters were sent on November 18`h, <br />November 28"', and December 8`~'. <br />Matt Galba noted that he was told to stop construction of a fence in his <br />front yard, noting that the sports court is not a fence. Galba felt that <br />defining the sports court as a fence was a stretch. Galba indicated that he <br />realized he was proceeding at this own risk, and pointed out that he is <br />trying Co work with the City on this issue. <br />Chris Cardinal, 2755 Lakeside Court, pointed out that there are basketball <br />and Cennis courts in front yards in Little Canada. Cardinal pointed out thaC <br />there are no parks within a mile or two of his house, and pointed out that <br />when he built his house he was required to pay a park charge. Cardinal <br />noted that the Galba's want a place for their children Co play and suggested <br />that a compromise could be worked out. Cardinal noted that the Galba's <br />removed two older houses and built a beautiful new home, thus improving <br />Che neighborhood. Cardinal felt there were a lot of Chings in the City that <br />do not comply with the Code. He again suggested a compromise be <br />worked out. <br />Blesener stated that given there are things out of compliance in the City, <br />that is not a reason to allow a sports court in the front yard. Allan also <br />noted the safety factor given the risk of pucks flying onto Edgerton Street. <br />Cardinal suggested that plastic netting could be put up to prevent pucks <br />from flying into Che street. He also suggested that rather than allowing <br />permanent lighting, thaC temporary lighting be utilized. Allan noted that <br />Galba's are using Cemporary lighting for the sports court. <br />LaValle questioned whether Cardinal would want this use in a fiā€¢ont yard <br />in his neighborhood. Cardinal reported that there are several code <br />violations in his neighborhood. He also commented on the numerous <br />requests that the City gets for Conditional Use Permits for oversized <br />garages, and the need to get storage inside. Cardinal felt there was an <br />appropriate compromise in this situation, and suggested that perhaps the <br />boards could be lowered on the sports court. <br />11 <br />
