MINNESOTA 55402 <br />TELEPHONE( 6i2: 339' 9 SO' <br />City Council <br />City of Little Canada <br />Little Canada, Minnesota <br />Gentlemen: <br />August 18, 1975 <br />As you know, by virtue of our letter of June 13, 1975: a <br />copy of which is enclosed, we represent Dr. Murray Tanasichuk, <br />the owner of the Sleepy Hollow Apartments, 180 -210 County Road B.2, <br />Little Canada, Minnesota, for the purpose of pursuing his claim <br />for damages against the Village of Little Canada for its failure <br />to provide proper drainage for surface waters flowing into a pond <br />directly to the south of the aforementioned apartment. buildings. <br />This letter is intended to present the City of Little <br />Canada with written notice pursuant to M.S.A. §466.05 (as amended <br />by Chapter 311, Session Laws 1974) that Dr.. Tanasichuk makes a <br />claim for damages in addition to those itemized in our letter of <br />June 13, as a result of the overflowing of the pond behind the <br />Sleepy Hollow apartments during the latter part of June following <br />the mailing of the aforementioned letter_ <br />On June 16 following a weekend of heavy rain, the waters of <br />the pond again began to move toward the apartments and one -half <br />of the backyard was submerged. The waters continued to creep up <br />toward the apartments throughout the following two weeks. Another <br />torrential downpour was experienced in the Little Canada area on <br />June 30 and July 1, and the waters of the pond moved up to and in <br />some instances into the buildings. Dr. Tanasichuk was again <br />forced to expend substantial sums of money in an attempt to re- <br />duce, if not eliminate, the threat of flooding by pumping water <br />out of the area. The attached list details the amounts expended <br />by Dr. Tanasichuk as a direct result of these floodings of late <br />June. <br />26 <br />
