L PROVISIONS <br />17. NONLIABILITY OF DISTRICT- The District shall be <br />forever wholly absolved from any liability for damages <br />which might result to the City on account of this lease <br />having been cancelled, forfeited, or terminated prior to <br />the expiration of the full time thereof. <br />18. ASSIGNMENT- It is mutually agreed that all the terms <br />and conditions of this agreement shall extend, apply to and <br />bind the successors and assigns of the respective parties <br />hereto as fully as the respective parties are themselves <br />bound, but this provision shall not authorize the assignment <br />or subletting of this agreement without the written consent <br />of the School Board of the District. <br />19. TERMINATION FOR SCHOOL PURPOSES -It is specifically <br />agreed that if and when the School Board of the District <br />determines and declares in good faith that all or part of the <br />leasehold included in this agreement is needed for the build- <br />ing or development for school purposes, and commences pro- <br />ceedings to effect such development, and notifies the Council <br />of the City, in writing, of such determination, this agree - <br />ment'shall automatically terminate within ninety (90) days <br />after the service of such.notice.either by delivery thereof <br />or depositing same in the United States mail addressed to <br />the City provided that if only a part of the leasehold is <br />needed for school purposes and if the board of the District <br />agrees, the City has the option to continue the lease sub- <br />ject to the covenants contained herein for that portion of <br />the leasehold not needed by the District for school purposes. <br />20. If the Council of the City fails to keep and perform <br />the covenants herein contained, or hereafter entered into, then <br />said Council does hereby authorize and fully empower the Board <br />of the District to terminate and annul this agreement <br />immediately and further empowers the board to perfect such <br />removal as it may deem advisable to recover exclusive <br />possession of all of said premises, including any and all im- <br />provements, building or otherwise of a permanent nature, <br />upon the premises at that time. <br />
