13. INSURANCE AND INDEMNIFICATION. -The City shall be <br />responsible for obtaining the indorsement of the District <br />as a named insured with the liability insurance carrier of <br />the City with liability limits to the extent required by <br />law for school districts. The City shall provide evidence <br />of such insurance to be filed in the office of the Business <br />Administrator of the District prior to the effective date <br />of this agreement. <br />The City agrees to indemnify and save and hold harmless <br />the District, its officers, employees and agents from any <br />and all claims and liabilities of any type or nature whatso- <br />ever and for damages to, loss of or destruction of any pro- <br />perty of a person, firm, corporation and /or other party and <br />for injury to or death of any person or persons which may <br />now or hereafter arise out of or result from or be in any <br />way connected directly or indirectly with this agreement. <br />14. USE OF LEASEHOLD BY DISTRICT- Unless otherwise auth- <br />orized by the school board of the District or its designated <br />agents ihcluding the Principal of the school located on the <br />leasehold, the City or its officers, employees or agents <br />shall not use the facility or any part thereof during the <br />hours and days when the District, as indicated by said <br />Principal, shall use the facility. <br />The District hereby covenants as follows: <br />15, QUIET ENJOYMENT -The District agrees that the City, <br />on performing the covenants aforesaid, shall and may <br />peaceably and quietly have, hold and enjoy the said lease- <br />hold for the term aforesaid, except as is in this lease <br />otherwise provided. <br />16. OPTION TO REBUILD -In the event that the Dstrict- <br />owned buildings situated on the leasehold should be partially <br />or totally lost or destroyed by fire or other casualty so as <br />to render them unfit in whole or in part for the purposes of <br />the City, then it shall be optional with the District to <br />rebuild them. But, unless the District notifies the City <br />within days after such loss of its intention to rebuild, <br />the City shall have the right to terminate the lease on <br />days written notice served on the District. <br />
