Because of a new sub- division creating a need for parks and, recreation <br />areas, as well as for streets, the City Council shall require that 5% of <br />the area of the sub - division be dedicated as park or recreation area, or <br />in the alternative that the sum of $100.00 per lot or per each residence <br />unit or units permitted on said lot be dedicated for parks and recreation. <br />Said sum may be paid for each lot as building permits on any lot are <br />issued within said sub - division. The construction of buildings containing <br />more than one residence unit on any parcel of real estate in the City no <br />matter how described is deemed to be covered by this paragraph irrespec- <br />live when platted. <br />24. IMPROVEMENTS <br />24.00 Requirements of Subdivider:' <br />Before the Council approves a final plat, the sub- divider shall give <br />satisfactory assurance of the installation of the following improvements. <br />Monuments. <br />Monuments shall be placed at all block corners, angle points, points of <br />curves in streets and at intermediate points as shown on the final plat and <br />as required by the City Engineer. Pipes or steel rods shall be placed at <br />the corners of each lot and at each intersection of street centerlines.; <br />All United States, State, County, or other official benchmarks monuments, <br />or triangular stations in or adjacent to the property shall be preserved in <br />precise position. <br />24.02 Streets. <br />(1) Grading. The full right -of -way of all streets shall be graded. <br />(2) Surfacing. All streets shall be improved with a bituminous <br />surface as provided in 25.03. <br />(3) Curb and Gutter. These shall be provided along all streets. <br />24.03 Sidewalks. <br />Sidewalks shall be installed if the Council shall determine it is in the <br />interest. <br />24.04 Water Main. <br />Where connection with the City water system is feasible, the public water <br />(k) Recreation and Open Space. <br />Each multiple family dwelling unit containing four (4) or more <br />units shall include a recreation area. Such a recreation area <br />may consist partially of appropriately landscaped open space <br />and shall include a play area, a portion of which shall contain <br />a paved surface. Such recreation area shall consist of not less <br />than twenty (20) percent of the gross area of the property and <br />shall consist principally of land within the building setback lines. <br />In addition, the City shall require one hundred (100) dollars per <br />unit for the City park system or a donation of land equal to five <br />(5) percent of the building site area provided such land k <br />acceptable to the Planning Commission and the City Council. <br />35.09 Cluster Development <br />35.091 Purpose. <br />The purpose of cluster developments is to make provision for <br />residential cluster projects on large tracts of land under single <br />or unified ownership. Such residential subdivision unit projects <br />will allow modification of individual lot area and width require <br />ments. Residential clusters shall be developed in accordance with <br />an overall design and integrated development plan in accordance <br />with the Subdivision Regulations and Comprehensive Plan. Such <br />project shall be consistent with the intent and purpose of this <br />Ordinance and shall not adversely affect the property adjacent <br />to the land area included in the project. <br />35.092 Regulations. <br />
