ORDINANCE NO. <br />AN ORDINANCE AMENDING THE LITTLE CANADA <br />CODE BY ADDING A NEW CHAPTER 1901, REGULA- <br />TION OF CONSTRUCTION, MAINTENANCE AND <br />OPERATION OF PRIVATELY OWNED SWIMMING POOLS. <br />THE COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. That. the Municipal Code of Little Canada is hereby amended by <br />adding a new Chapter 1901, relating to the regulation of construction, maintenance <br />and operation of privately owned swimming pools to read as follows: <br />"1901. REGULATION OF PRIVATELY OWNED SWIMMING POOLS. <br />1901.010. SWTNMING POOL DEEMED TO BE A STRUCTURE. A swimming pool, as <br />hereinafter defined, is deemed to be a structure and subject, therefore, to regula- <br />tion and control under the Zoning and Building Codes of the City of Little Canada.. <br />1901.020. DEF'LNIT_IONS. For the purposes of this Ordinance, a swimming pool <br />is defined as a privately owned, outdoor pool, either above - ground or in- ground on <br />private property, having the capacity of over 1000 gallons of water or 12 feet of <br />water depth and intended to be used for swimming or bathing purposes. <br />1901.030. BUILDING PERMIT REQUIRED. A building permit shall be required for <br />the construction, installation, enlargement or major alteration of any swimming pool <br />as defined in Section 1901.020. No new pool or altered existing pool shall be filled <br />or used until it shall have conformed to the provisions of this Ordinance. <br />1901.040. APPLICATIONS. The application for a building permit to construct, <br />erect or install a swimming pool shall be accompanied by plans of sufficient detail <br />to show the proposed location, size and dimensions of the pool, and the location of <br />all structures on the same lot. In addition, the plans shall show the proposed <br />screening or landscaping as well as the location of all equipment to be installed in <br />connection with the operation of the pool such as pumps, filters and heaters and the <br />location of all existing and proposed utility lines. <br />1901.050. LOCATION. Swimming pools shall be located on single or double <br />family premises so that the outside perimeter, including all accessories, shall not <br />be closer than 10 feet to any side or rear lot line and no pool shall be located <br />beneath or within 10 feet of any overhead utility lines or over any underground <br />utility lines. Pools shall not be located within any utility, drainage or walkway <br />easement, public or private. Pools on multi- family premises, such as apartment <br />dwellings, shall not be located closer than 50 feet to any side or rear lot line. <br />38 <br />
