MINUTES <br />CITY COUNCIL <br />MARCH 27, 2013 <br />Subdivision Code. The Administrator reported that the City Engineer has <br />revised these options and based on a cursory review feels that substantial <br />fill (at a cost of approximately $20,000) will be required on the Brausen <br />property alone. <br />The Administrator then reviewed in detail the ghost plat. He pointed out <br />that the ghost plat assumes that the three property owners would work <br />together (Acosta /Boog /Brausen). However, he noted that to develop these <br />properties has always required the cooperation of landowners. The <br />Administrator reported that City staff met with these three property <br />owners in late January and the concern was that the ghost plat brings the <br />road through the backyards of the Acosta and Boog properties. The <br />Administrator reported that there was also discussion about the City's <br />acquiring the back portion of the Brausen property and holding it until <br />Acosta and Boog are ready to develop their properties. The Administrator <br />noted that in those discussions with the Brausen's, an understanding on <br />purchase price could not be reached. <br />The Administrator pointed out that regardless of whatever option is <br />decided upon for the development of the Acosta /Boog /Brausen properties, <br />there are a number of considerations that make development challenging if <br />there is not cooperation among all three property owners. These <br />challenges include and are outlined in detail in the Administrator's March <br />2211`1 report: paying for the cost of the improvements needed to serve these <br />properties, grading, and drainage. <br />The Administrator then reviewed the recommendation outlined in his <br />report. This recommendation is that the City vacate the entire 33 -foot <br />easement. Assuming the title will vest to the owner of 2966 Arcade Street <br />(Masterpiece Homes), staff recommends that Masterpiece Homes deed the <br />easterly 25 feet of the vacated easement to the City from the westerly <br />property line of proposed Lot 3, Block 1, Pinetree Pond, continuing north <br />to the northerly line of the easement in question. The Administrator <br />reviewed a diagram showing this concept. He noted that the City, in turn, <br />would hold this land for the owners of the Acosta /Boog /Brausen <br />properties until a development is proposed involving all three properties. <br />When that occurs, the City will deed the 25 feet to those owners <br />conditioned upon their agreement that the road right-of-way dedicated to <br />serve their proposed subdivision can't use this 25 feet except for the new <br />street to cross the former easement area. The Administrator pointed out <br />that this recommendation will not achieve the Brausen's goal of <br />developing their property sooner rather than later, but it keeps the <br />possibility in play in a manner that requires less cooperating property <br />owners than was necessary before Pinetree Pond. This option requires the <br />Acosta/Boog /Brausen property owners to dedicate a net 25 feet of land for <br />12 <br />
