MINUTES <br />CITY COUNCIL <br />MARCH 27, 2013 <br />Jan Bilek, 2925 LaBore Road, reported that four of the proposed houses in <br />Pinetree Pond will abut her property, and noted that some of these lot are <br />the smallest in the Pinetree Pond development. Bilek noted that the <br />houses proposed for Lots 11 and 12 will be two -story and will be looking <br />down over her house. Bilek asked that Gordie Howe address the issue of <br />the trees, noting that there are 62 50 -foot pines that Howe verbally agreed <br />to retain. Bilek reported that the Kupferschmidt's included in the purchase <br />agreement with Howe that the trees within the easement should be <br />retained, and this was included with the specific intention of protecting the <br />Bilek property. Bilek reported that the loss of these trees will affect how <br />they live in their house and yard. <br />Bilek also stated that whether or not they sell the back of their property for <br />development is not a big issue. She indicated that she would like to see <br />the road easement remain adjacent to her lot for potential development <br />access. She also commented that there was the previous indication from <br />the City that a non - conforming setback of a foot or two for her house if a <br />road was improved on the easement was not going to be a big deal. Bilek <br />pointed out that her property is just as large as other properties that are <br />being discussed this evening. Bilek felt that while the City is showing <br />concern for future development potential of these other properties, they <br />are not showing this same concern for her property. Bilek indicated that <br />because of the impact of the Pinetree Pond plat on her property, they may <br />have to sell. <br />The City Attorney noted that the purchase agreement between Howe and <br />the Kupeferschmidt's is a private agreement that the City has no <br />involvement with. <br />Gordie Howe, Masterpiece Homes, reported that he called Dave Brausen <br />and set up a meeting with him and Steve Brausen since he had heard that <br />Steve Brausen was interested in selling at $100,000 per lot. I -Iowe <br />reported that in meeting with them in no way did he lead them to believe <br />that he would support their bulb plan. Howe reported that at that meeting <br />he informed them that the Ramsey County Surveyor indicated that when <br />he worked as the Washington County Survey he would not have allowed <br />the bulb plan. Howe informed the Brausen's that in Ramsey County, road <br />layouts are approved by the cities. Howe further stated that he informed <br />the Brausen's that he would not do the bulb plan and have assessments <br />deferred against the Boog property. Howe reported that Masterpiece <br />Homes owns 2966 LaBore Road, the City does not own any of this <br />property. The City holds a $200,000 plus mortgage on the property. <br />I -Iowe then reported that Masterpiece Homes purchased the Kupferschmidt <br />and Rauser properties, and there was no City financing provided for these <br />two properties.
