B. In the event an animal is impounded and boarded by the City iioaith <br />Officer or placed under quarantine by ruling of the State Board of health, <br />r,ai.d animal shall be boarded as required by said order or ruling. At the <br />end of such period, the City releases a:i1 interest, right and control over <br />said animals and they may then be disposed of at the discretion of the <br />Town. In the event that any dogs, cats, or other impounded animals are <br />unclaimed for a period of five (5) business days, they shall become the <br />property of the Town and may be disposed of or sold at its discretion, <br />subject to Minnesota Statutes 35.71. All proceeds from the disposition <br />of such animals may be retained by the Town, including any proceeds re- <br />ceived from any animals disposed of in accordance to Minnesota Statutes <br />X5.71. <br />9. The Town shall equip all vehicles with two -way radios and /or <br />other communication equipment to provide communication with the Ramsey <br />County Sheriff Department and agrees to service and maintain said <br />equipment. <br />The Town shall assume liability for all harm to animals, persons, <br />, or employees, due to its negligence or the negligence of its <br />gents in not properly caring for the same, and agrees to defend any <br />L »g'=j actions arising therefrom. The Town shall provide the City with <br />proof of public liability insurance including comprehensive automobile <br />ability in an amount of at least $100,000 per each claimant and $300,000 <br />'or each occurence. <br />11. The Town agrees that during the period of this contract it Will <br />not, within the State of Minnesota, discriminate against any employee or <br />e.;plieent for the employment because of race, color, creed, national origin, <br />.,r ancestry, and will include a similar provision in all subcontracts <br />entered into for the performance hereof. This paragraph is inserted in <br />his eDntreet to comply with the provisions of Minnesota Statutes 181.59. <br />12. The Town agrees to limit the use of anesthetic administered by a <br />_oal:;on or dart gun for the capture of stray animals. This method is to be <br />.eed only in the case of vicious animals, animals suspected of having <br />contracted rabies, and animals which are continually seen loose and cannot <br />ue picked up or followed to its proper owner or shows definite signs of <br />h.eing a long-time stray. <br />15 <br />
