Box 2128 St. Paul, Minnesota 55109 August 29, 1979 Re: Proposed Filling of the Michael Theis Land Located West of Greenbrier Circle and North of County B -2. Dear Mr. Chlebeck: 1 have reviewed the available information for the proposed filling of the above described parcel. At this time, the Board will have several concerns regarding this filling. As you are aware, there are flooding problems on the chain of lakes. As the Watershed District has not com- pleted a water management program for this area, it is usually the Board's policy to allow filling within the floodplain of the chain lakes only when compensation for this filling has been provided so that there would be no net filling of the floodplain. Also, the area to be filled is a wetland which apparently is not normally connected to Gervais Lake. It is connected, however, during flood stages. The Board feels areas of this type are very important for treating stormwater both in nutrient removal and removal of sediment. From my review, it appears this filling proposal will require both a DNR permit and a Corps of Engineer's permit due to its proximity with the normal ordinary high water mark and Gervais Lake. The District usually makes an effort to coordinate its concerns with both of these agencies, therefore, you may want to invite comment from the DNR and the Army Corps of Engineers. Mr. Theis' application will come before Board review on September 6, 1979. These concerns will be discussed at that time.
