Box 2128 St. Paul, Minnesota 55109 <br />August 29, 1979 <br />Re: Proposed Filling of the Michael Theis Land <br />Located West of Greenbrier Circle and North of County B -2. <br />Dear Mr. Chlebeck: <br />1 have reviewed the available information for the proposed filling <br />of the above described parcel. At this time, the Board will have several <br />concerns regarding this filling. As you are aware, there are flooding <br />problems on the chain of lakes. As the Watershed District has not com- <br />pleted a water management program for this area, it is usually the Board's <br />policy to allow filling within the floodplain of the chain lakes only when <br />compensation for this filling has been provided so that there would be no <br />net filling of the floodplain. Also, the area to be filled is a wetland <br />which apparently is not normally connected to Gervais Lake. It is connected, <br />however, during flood stages. The Board feels areas of this type are very <br />important for treating stormwater both in nutrient removal and removal of <br />sediment. <br />From my review, it appears this filling proposal will require both <br />a DNR permit and a Corps of Engineer's permit due to its proximity with the <br />normal ordinary high water mark and Gervais Lake. The District usually <br />makes an effort to coordinate its concerns with both of these agencies, <br />therefore, you may want to invite comment from the DNR and the Army Corps <br />of Engineers. <br />Mr. Theis' application will come before Board review on September 6, <br />1979. These concerns will be discussed at that time. If Mr. Theis wishes <br />to appear to express his concerns, he should contact me prior to the Sept- <br />ember meeting at 920 -0655. <br />SMR /lv <br />ely, <br />S en M.
