1801.020. DEFINITION AND ESTABLISHMENT OF WETLAND AREA. The Wetland <br />conservation area within the City of Little Canada is defined and established <br />to be the shore lines of Gervais Lake, Savage Lake, Round Lake and Twin <br />Lake and the low areas adjoining any watercourse and drainage way, natural <br />or man -made, subject to meandering, flowing or overflow, including areas <br />of marsh, wooded marsh, submerged marsh and inundation areas as shown on <br />the wetlands map, attached hereto and made a part hereof by reference. <br />1801.030. REGULATION OF DEVELOPMENT. Any person, firm or corporation <br />desiring to develop, improve or alter land or build any structure upon <br />land located within the wetland conservation area or change the shoreline of <br />any lakes within the area shall first submit a development plan to the City <br />Council which shall contain provisions for water management, sediment <br />control, maintenance of landscape features and any other matters which <br />pertain to the quality of the environment. Said plan shall show all changes <br />proposed in the natural condition of the soils, destruction of or relocation <br />of trees, grade changes and the anticipated effects, if any, such changes <br />may have upon the immediate surrounding area. <br />1801.040. CERTAIN DEVELOPMENT PROHIBITED. No development, including <br />excavation, filling, dredging, grading and construction shall be allowed <br />within the wetland conservation area if such is incompatible with the <br />policies expressed in this Ordinance and the preservation of said wetlands <br />in their natural state. No changes in the shorelines of any of the lakes <br />within the City of Little Canada shall be permitted in anyway, including <br />excavation or filling, without issuance of a permit by the City for such <br />change. <br />1801.050. LAND DEVELOPMENT AND PLATTING. No part of any land within <br />the wetlands conservation area shall be platted for residential or any <br />other use in contravention of the policies set forth in this Ordinance. <br />Whenever a portion of the conservation area is located within the area <br />to be subdivided, an easement over the lowlands shall be dedicated by <br />the subdivider for the purpose of improving and protecting the area for <br />drainage or other purposes expressed in this Ordinance. Streets, driveways, <br />culverts and other similar structures shall not be built unless prior <br />approval has been obtained from the City Council and such structures shall <br />be designed so as not to obstruct the flow of water. <br />1801.060. LAND AREA CREDIT. When land to be developed is connected to <br />a public sanitary sewer line and includes land within the wetland conservation <br />area, the owner or developer thereof will be credited with an amount of his <br />land within the protected area equal to but not exceeding the amount of his <br />adjacent land which otherwise qualifies for development under these Ordinances <br />for purposes of complying with the land use density, open space, building unit <br />to land area ratios or other similar requirements of the land development <br />and zoning Ordinances of the City, except for requirements for recreational <br />uses. <br />1801.070. SPECIAL ASSESSMENTS. The land area in the wetland conservation <br />area which will not be developed and which is dedicated as an easement shall be <br />exempt- from special assessments, including but not limited to sanitary sewer, <br />storm sewer and water line improvements. <br />
