GEARAn <br />REPLY TO Saint Paul <br />We have been asked to assist Centennial Contractors <br />Corporation in the collection of certain amounts which are due <br />them in connection with their construction of the projects <br />identified above. Relevant facts include the following: <br />provides: <br />1. The Contract between the City and Centennial <br />"All tests on restoration work deemed <br />necessary by the County Engineer shall <br />be made at the applicant's expense." <br />(See Specifications, Ramsey County, U2, page 2, item 14.) The <br />"applicant" referred to is the City which applied for and obtained <br />necessary permits to perform utility 'construction on county <br />rights -of -way. <br />2. During the course of Centennial's construction <br />of the project, the County required a number of compaction <br />tests. Centennial, relying on the above quoted provision of <br />the Contract, arranged and paid for the County- required tests. <br />CITY Hi- <br />J <br />
