Mr. <br />Drake asked who would take responsibility for water damage. Mr. <br />Marshall said so far this has been a private action on private <br />property. After a permit has been granted or denied, then the <br />agency could be brought into an action. The City gave him a <br />permit to fill about a year ago. Pres. Lake said our options are <br />in effect, to stay with our original decision to deny the permit <br />and enjoin any development and subsequent development that could <br />be with or without removing existing fill, or to reconsider the <br />original permit as the developer originally proposed, with more <br />or less filling and compensating excavating. Fir. Sprosty was told <br />the County controls the level of the lakes. Pres. Lake asked if <br />the slope could be gentler on lots 5 and 6. A strip about 100' <br />wide has been excavated and worked on up to the creek. Mgr. Lyon <br />said we should specify the minimum elevation they can build at so <br />that future buyers could be warned. He asked Mr. Klein what effect <br />a 4 - 1 slope would have on the area right now, and what the effect <br />on storage and water quality would be if a permit were granted. <br />Mr. Klein did not know what effect this would have upstream. We <br />should now provide for upstream storage when the large developer <br />we have heard about brings in his plat. <br />Pres. Lake mooted we reconsider the denial Permit #138; an Motion <br />further that we grant Permit #138 with the condi ions hat, <br />"1) the minimum basement floor elevation be at the minimum elevation <br />of 864.6'; 2) that the minimum side slopes on the county ditch be <br />at the minimum 1 on 4; 3) that the back portions of lots 6, 7 and <br />8 be covered by a drainage and utility easement granted to the <br />City of Little Canada; 4) that fill in lots 7 and 8 be extended <br />for 100' to the west of the Keller Pkwy. easement. Mgr. Newmark <br />seconded the motion. Mr. Klein said he would like an addition to <br />the motion. Pres. Lake moved it be amended to include that fill <br />on lot 7 may be extended southerly to the bank of the creek, with <br />the side slope previously mentioned and material to be excavated <br />from the bottom and side of the county ditch. Motion failed due <br />to lack of a second. Mgr. Lake then moved it be amended to <br />provide for southerly filling on lot 7 to the edge of the creek <br />with the appropriate side slope, and with fill and material being <br />obtained on site. Mgr. Lyon seconded the motion, and amendment <br />passed, unanimously. There was a unanimous approval of the <br />original motion, as amended. In the absence of the President and <br />Vice President, the Secretary will sign the permit. <br />With regard to the Clapp- Thompson development, Permit #27, <br />Fr. Genzch was concerned with dcmolotion waste being used for <br />fill and is a fairly sizeable one so the County gets involved <br />in it. There are concerns about surface and ground water <br />pollution. Mr. Genzch has not seen the original plans, but does <br />not know what Clapp - Thompson intends to do about it. They are <br />using asphalt, concrete, tires, etc. Our permit conditions were <br />for clean fill. Our Attorney can write a letter to enjoin all <br />future fill and related activities including building, until <br />such time non -inert materials are removed, or to enjoin all <br />future action and complete the filling with inert fill and seal <br />'off the non -inert materials, and then complete the project. <br />Permit "27 ' <br />Liu <br />9 <br />
