Little Canada Mayor, City Council and <br />Planning Commission <br />July 1, 1980 <br />Page Three <br />Also as a condition of approval, six foot drainage easements should be provided along <br />the west property line and the new division line (see Exhibit D). Drainage easements <br />are probably not necessary along the southern property line since water will flow <br />northward anyway. It is also presumed that drainage along the east edge of the <br />property is contained within the Arcade Street right -of -way. <br />Since the property in question directly abuts Gervais Lake, approval of any sub- <br />division should be contingent upon favorable review and comment by the Ramsey - <br />Washington Metro Watershed District. <br />5 Side Yard Variance - Existing Residence. As shown on the applicant's Certificate <br />of Survey, the eastern boundary of proposed Lot 2 abuts the existing swimming pool. <br />In discussing this with Mr. Lee, he indicated that the pool line shown is actually <br />a fence and that the pool is actually about 10 feet east of what has been shown. If <br />three lots are to be considered, the actual location of the pool should be shown. <br />If, as recommended, only two lots are permitted, the division line should be moved <br />westward so that the side yard for Lot 1 complies with the Zoning Ordinance. <br />6. Approval by Maplewood. Although the property in question lies partially within <br />the City of Maplewood, the City Attorney has indicated that since the actual split <br />occurs within Little Canada, Maplewood's approval is unnecessary. However, the <br />City may wish, in the interest of intergovernmental cooperation, to refer the request <br />to the City of Maplewood for brief review prior to approval of subdivision. <br />RECOMMENDATION <br />Based upon the preceding discussion, it is suggested that the Planning Commission recommend <br />to the City Council approval of two lots as shown in Exhibit D. The variances necessary to <br />allow the split may be granted and justification for all variances clearly specified in the <br />recommendation. <br />It is further recommended that in the future, the City require resubdivision plans for any <br />subdivision which results in lots or parcels much larger than those required by the Little <br />Canada Zoning Ordinance.
