000.040. Prohibited Acts. <br />No person shall make, continue, or cause to be made or continued, any <br />noise in excess of Minnesota Pollution Control Norse Standards. <br />000.041. Adoption of State Noise Standards. <br />Minnesota Pollution Control Noise Standard NPC1 and NPC2, 1977, are <br />adopted and incorporated by reference. <br />000.042. Additional Measurement Procedure. <br />Sound level., measurements for this section shall be monitored at a` <br />point of human activity within the sound receiving unit. <br />000.043. Specific Prohibitions. <br />The following acts and the causing thereof are declared to be in <br />violation of this.ordinance: <br />A. <br />B. <br />C. <br />D. <br />E. <br />etc. <br />000.050. Exceptions. <br />A. Emergency Exception. The provisions of this Ordinance shall not <br />apply to (a) the emission of sound for the purpose of alerting persons to the <br />existence of an emergency, or (b) the emission of sound in the performance of <br />emergency work. <br />B. Circumstantial Exceptions. It is recognized that under certain <br />circumstances it would be impossible for a noise source to comply with all the <br />provisions of this Chapter due to economic or technological reasons. In cases <br />such as this, application for an exception may be made in writing to the City <br />Office. The application shall contain the following pertinent information: <br />1. Dates for exception requested. <br />2. Location of particular noise source and times of operation. <br />3. Equipment involved. <br />4. Necessity for request of exception. <br />5. Steps taken to minimize noise level from source, and <br />6. Names of responsible persons. <br />Applications will be reviewed by the City Office and a decision to approve <br />or deny the exception will be made in writing to the responsible persons within <br />twenty (20) days of receipt. <br />
