TWELFTH RIDER TO AGREEMENT THIS AGREEMENT, Made this day of BOARD OF WATER COMMISSIONERS OF THE CITY and the CITY OF LITTLE CANADA, County of , 1980 by and between the OF SAINT PAUL, hereinafter called the "Board" Ramsey, State of Minnesota, hereinafter called the "City ", being the Twelfth Rider to that certain Agreement made by and between said Board and said City the 13th day of July, 1966 and by this reference incorporated herein and made part hereof and with the sane intent, purpose and effect as if said Agreement were set forth herein verbatim. WHEREAS, The Board is owner of a 175 foot wide right -of -way across the south one -half (Sz) of the northwest one - quarter (NW) and northeast one- quarter (NE4) of Section Six (6), Township 29 North, Range 22 West, County of Ramsey, hereinafter de- signated as Premises; and WHEREAS, The City desires permission to enter upon certain portions of said Premises to install and operate a fifteen-inch (15 ") storm water sewer and portions of a storm water pond earth embankment; and WHEREAS, The Board is willing to grant said permission to the City consistent with the requirements and safety of the works of the Board; NOW, THEREFORE, BE IT AGREED, In consideration of the mutual promises and agree- ments of the parties hereto, that: 1. Said Board hereby grants to said City the permission to install and operate a fifteen -inch (15 ") storm water sewer across the Premises and a portion of a storm water pond earth embankment on and along the west edge of the Premises, as outlined in red color and located as shown on attached drawings marked Exhibits "A" and "B ". 2. A minimum clearance of 1.0 foot must be maintained between the bottom of the fifteen -inch (15 ") storm sewer pipe and the top of the ninety -inch (90 ") conduits. 42
