5. The City shall have the right but not the obligation to enter upon the <br />grounds for repair and maintenance purposes following due notice under the <br />following conditions: <br />a) The property is deemed by the City Council as being in a poor <br />state of repair and /or maintenance contrary to the general public <br />interest and provisions of this PUD Permit; and <br />b) PUD property owners have failed to make needed repairs and proper <br />maintenance on buildings and /or grounds following written notice <br />of findings approved by the City Council. <br />The City shall assess the property owners for any and all expenses <br />incurred. <br />Maintenance shall include replacement of dead and diseased trees and other <br />plantings, proper watering, use of fertilizer, mowing and the like. • <br />Detailed plans shall be required for all uses within the PUD area including <br />the duplex structures. <br />6. Circulation Component <br />Description: the Circulation Component attached hereto as Exhibit "0" is <br />hereby approved by the City. <br />REQUIREMENTS <br />Plans and specifications for any access drives, private or public streets, <br />all paved surfaces, utilities, and other development features to be <br />constructed and used must be approved by the City Engineer. The developer <br />shall supply the City with any data, plans, or as- builte that may be <br />requested by the City Engineer. <br />Adequate right -of -way for streets, pedestrianways, utilities, ponding storm <br />water drainage, or other public purposes shall be provided ae may be <br />requested by the City. <br />3. All PUD development shall be properly related to and coordinated with <br />development plane for adjacent and nearby areas. <br />The City reserves the right to regulate and control vehicular and pedestrian <br />circulation on both public and private land within the PUD area. <br />No building permits shall be issued until a Development Contract is executed <br />noting financial and other responsibilitiee of the developer related to <br />circulation component elements. <br />C. Population Component <br />Description: The Population Component attached hereto as Exhibit "E" is <br />approved by the City. <br />RM.QUIREIENTS <br />The number and type of building structure shall be constructed as authorized <br />and noted on the approved Exhibit "F ". <br />Construction quality and architectural treatment of all building structures <br />shall be subject to City approval. <br />D. Subdivision Component <br />Description: The General Development Plan attached hereto as Exhibit "G" <br />is hereby approved. <br />
