5. The City shall have the right but not the obligation to enter upon the grounds for repair and maintenance purposes following due notice under the following conditions: a) The property is deemed by the City Council as being in a poor state of repair and /or maintenance contrary to the general public interest and provisions of this PUD Permit; and b) PUD property owners have failed to make needed repairs and proper maintenance on buildings and /or grounds following written notice of findings approved by the City Council. The City shall assess the property owners for any and all expenses incurred. Maintenance shall include replacement of dead and diseased trees and other plantings, proper watering, use of fertilizer, mowing and the like. • Detailed plans shall be required for all uses within the PUD area including the duplex structures. 6. Circulation Component Description: the Circulation Component attached hereto as Exhibit "0" is hereby approved by the City. REQUIREMENTS Plans and specifications for any access drives, private or public streets, all paved surfaces, utilities, and other development features to be constructed and used must be approved by the City Engineer. The developer shall supply the City with any data, plans, or as- builte that may be requested by the City Engineer. Adequate right -of -way for streets, pedestrianways, utilities, ponding storm water drainage, or other public purposes shall be provided ae may be requested by the City. 3. All PUD development shall be properly related to and coordinated with development plane for adjacent and nearby areas. The City reserves the right to regulate and control vehicular and pedestrian circulation on both public and private land within the PUD area. No building permits shall be issued until a Development Contract is executed noting financial and other responsibilitiee of the developer related to circulation component elements. C. Population Component Description: The Population Component attached hereto as Exhibit "E" is approved by the City. RM.QUIREIENTS The number and type of building structure shall be constructed as authorized and noted on the approved Exhibit "F ". Construction quality and architectural treatment of all building structures shall be subject to City approval. D. Subdivision Component Description: The General Development Plan attached hereto as Exhibit "G" is hereby approved.
