the PUD permit and the General Development Plan constituting a part <br />thereof; provided, however, that nothing herein shall be construed to <br />create non - conforming lots, building sites, buildings or uses by virtue of <br />any such conveyance of a lot, building site, building or part of the <br />development created pursuant to and in conformance with the PUD permit. <br />Subsequent structural additions or alterations may be made provided the <br />provisions of the PUD permit, this and other applicable Ordinancee are <br />adhered to. <br />More detailed and complete site and building plane may be required from <br />time -to -time as development proceeds within the project area in accordance <br />with the approved stage development program. <br />7. Any requests for major deviation from the approved plan shall require a <br />public hearing and consideration by the City. <br />Where there are particular difficulties or unnecessary hardships resulting <br />from the application of the strict letter of the conditions of this Permit, <br />an appeal may be made and a variance may be granted as provided for in the <br />Code of Ordinances of the City. <br />The conditions of this Permit are applied to the land and shall not be <br />affected or altered by any subsequent sale, lease, rental or any other <br />change in ownership or tenant status except as may be provided herein. <br />10. The Applicant for various stages and portions of the development may be <br />different from the original. Applicant and separate Planned Unit Permits may <br />be issued for various parts and stages of development. Each separate <br />permit, however, shall conform to the approved Concept Plan and general <br />Plan of Development and shall be and remain a part of the original permit <br />and shall be considered as an amendment and /or addition thereto. <br />11. The Applicant shall promptly pay all consultant and legal fees incurred by <br />the City in conjunction with the PUD approval, monitoring, inspection and <br />enforcement. If the bills are not paid within thirty (30) days after <br />receipt by the Applicant the City may halt all development work and may <br />refuse to further process the PUD. <br />RERUIRED COMPONENT DETAILS <br />A. Land Use <br />Description: The Land Use Component attached hereto as Exhibit "C" is <br />hereby approved by the City. <br />Requirements: <br />Only those uses listed herein as permitted and /or as indicated on the <br />approved plans shall be provided for on the PUD site. <br />Land uses permitted shall be located, constructed, occupied and maintained <br />in accordance with the provisions of this Permit and approved plane and <br />other documents attached hereto and made a part of this Permit. <br />Building or occupany permits shall not be issued until detailed and specific <br />plans for each principal use has been reviewed by the Planning Commission <br />and approved by the City Council. Detailed plane shall include <br />landscaping, parking, access drives, building location and elevations, <br />specific uses, provisions for loading and waste storage and disposal, <br />signs, lighting, utilities, provisions for building and grounds maintenance <br />and such other information ao may be requested by the City Staff. <br />4. An Occupancy Permit shall be required for all uses in buildings and on <br />grounds including individual businesses to be located in the retail /office <br />convenience center. <br />
