Any hours in addition to the 160 hours must be <br />paid in cash at time and one -half the regular rate of pay. <br />Mr. Peterson confirmed our opinion that compensatory time <br />may not be lost because it is not used by the employee. In fact, <br />if compensatory time is cashed by the employee at a time other <br />than termination, it must be paid at the current wage rate rather <br />than at the wage rate in effect at the time the compensatory time <br />was accumulated.
