MINUTES <br />Planning Commission <br />Becker Becker pointed out that when he first purchased the property, the <br />Lot Split City would not allow him to place the house where he wanted because <br />& Variance of the proposed road. Becker stated that he had the understanding <br />(Cont.) that the City would purchase part of his property for a road. <br />Herkenhoff felt that the variance should be granted because of <br />this background. <br />Timmons stated that the issue was not clear. Timmons felt that <br />the variance should be denied and pointed out that similar variances <br />have been denied in the past. <br />Becker pointed out that the property is 75 feet wide by 200 feet deep, <br />and he saw no reason why the lot split should not be approved. <br />Mr. Herkenhoff recommended that the Becker lot split and variance <br />be approved considering the background history of the property. <br />Mr. Perlinger seconded the motion. <br />Motion carried 4 - 3. Schweizer, Perlinger, Costa, Herkenhoff <br />voting in favor while Davison, DeLonais and Timmons voted against. <br />Motion approved. <br />DeLonais felt that Commission action would set a precedent. <br />Herkenhoff disagreed given the history of the property. <br />Timmons noted that when Becker first purchased the property it was <br />not subject to the City paying him a certain amount of money for a <br />road easement. All that was required was that Becker move his <br />house over should a road ever be improved in the area. <br />Timmons did commented, however, that she did not feel the property <br />division would adversely effect the neighborhood, she voted against <br />the motion as there were not enough legal facts present to justify <br />the variance. <br />DeLonais agreed that it was a legal issue, not one of impact to the <br />neighborhood. <br />Meise <br />Accessory <br />Building <br />CUP <br />Mr. Gary Meise, 2992 Vanderbie Road, appeared before the Commission <br />requesting approval of a conditional use permit to construct an <br />accessory building on his property. Meise noted that the building <br />would be used for storage of personal utilities, firewood, and for <br />raising homing pigeons. Meise noted that the building would not be <br />heated, nor would there be any insulation in the building. <br />The Planner stated that the ordinance requires a CUP for an <br />accessory building. <br />Page 5 <br />
