The second paragraph means that an interpreter must be <br />provided whenever a hearing - impaired person is taken to <br />a "place of detention" (e.g., a jail) because of an <br />alleged violation of a criminal law. The interpreter is <br />to assist with the explanation of rights and procedures <br />concerning detainment. An interpreter must be available <br />to assist with the interrogation or questioning of a <br />hearing- impaired person. <br />C. Federal Court Proceedings: <br />28 U.S.C. §1828. <br />In federal court, interpreters must be appointed for <br />hearing impaired persons in all criminal and civil <br />actions which are initiated by the United States. <br />II. Laws and regulations requiring the provision of interpreters <br />for meetings or contacts with county, state, or city offices <br />and employees and for needed social services. <br />A. The Minnesota Human Rights Act, Minn. Stat. Chpt. 363. <br />(a) M.S.A. 363.03, subd. 4, states that "public <br />services" cannot discriminate based on <br />disability and must provide "program access ". <br />(b) "Public Services" are defined at 363.01, <br />subd. 19, and include all facilities, <br />departments, agencies, boards or commissions <br />which are owned, operated or managed by or on <br />behalf of the State of Minnesota or any <br />subdivision thereof, including any county, <br />city, town, township or independent district. <br />In other words, all state and local government <br />entities are "public services <br />(c) "Program Access" is defined at M.S.A. 363.01, <br />subd. 34. It requires the provision of <br />auxiliary aids or services (which includes <br />interpreters) to ensure full and equal use of <br />or benefit from the goods, services, and <br />privileges provided by "public services ". <br />(d) Therefore, if a hearing- impaired person needs <br />to talk with an employee of any city, county, <br />or state office, that office must provide <br />interpreter services for the meeting if needed <br />to ensure equally effective services and /or <br />information. <br />Page 5 <br />
