MINUTES <br />CITY COUNCIL <br />DECEMBER 20, 2006 <br />Nays (0). Resolution declared adopted. <br />PURCHASE The City Administrator presented the Council with a revised purchase <br />AGREEMENT - agreement for 91 Viking Drive West, and noted that the proposed <br />91 VIKING revisions are the result of the City Attorney's review. The Administrator <br />DRIVE WEST noted that the acquisition of 91 Viking Drive West would allow for the <br />realignment of Viking Drive. He also reviewed the various contingencies <br />included in the purchase agreement that would have to be satisfied before <br />the acquisition would proceed. <br />Mr. Keis introduced the following resolution and moved its adoption: <br />RESOLUTIONNO. 2006-I2-300 -APPROVING THE PURCHASE <br />AGREEMENT FOR 9I VIKING DRIVE WEST AS PRESENTED BY <br />THE CITYADMINISTRATORRND AS MODIFIED BY THE CITY <br />ATTORNEYAND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />VADNAIS The City Administrator reported that in May of 2005, the City of Vadnais <br />HF,IGHTS Heights informed us that the sewer services for certain County Road D <br />SEWER apartment complexes were being charged to the City of Little Canada. <br />BILLING This billing situation had been in place since the early 1970's. The <br />ISSUE Administrator reported that Little Canada staff has been meeting with the <br /> Vadnais Heights City staff to resolve this issue and gain reimbursement <br /> for these charges. Vadnais Heights' staff has indicated that the Statute of <br /> Limitations may apply relative to the amount of reimbursement that Little <br /> Canada can obtain. The City Administrator noted that there are exceptions <br /> to this Statute that may apply. The Administrator reported that in order to <br /> protect Little Canada, the City Attorney is recommending that a lawsuit be <br /> commenced. The City Administrator indicated there is a substantial <br /> amount of money involved, and estimated the principal to be in the range <br /> of $250,000, plus interest. <br />The City Administrator reported that this issue has just been brought to the <br />Vadnais Heights Finance Committee, that it would be his recommendation <br />to allow the Committee more time to review the matter. The <br />Adminish~ator suggested that the matter be brought bac]c to the City <br />Council at its January 10°i meeting. If there is no progress made with <br />15 <br />
