MINUTES <br />CITY COUNCIL <br />DECEMBER 20, 2006 <br />Vadnais Heights at that point, the Council could take action to initiate a <br />lawsuit. The City Attorney concurred with that recommendation. <br />Blesener noted that Little Canada has been working with Vadnais Heights' <br />staff on this issue for quite some time. While he is willing to wait until the <br />January 10°i meeting, Blesener indicated that there needs to be some <br />positive movement from Vadnais Heights on the issue. Without some <br />progress, Blesener stated that he would vote to initiate a lawsuit. Council <br />agreed. <br />AUTO Blesener indicated that given the varying types and numbers of auto <br />LICENSES licenses in the City as well as applicable zoning regulations, he had <br />suggested that the Council consider a moratorium on the issuance of <br />additional licenses pending a study of this matter. Blesener asked if the <br />varying types of these licenses as well as Little Canada's limitation of four <br />retail auto sales licenses is typical of what other cities do. <br />The City Planner replied that there is no set criteria for limitations on <br />numbers of licenses based on City size or other criteria. The Planner <br />suggested that his office could put together a survey showing how other <br />cities handle auto licensing. <br />The City Administrator noted how the auto sales business has changed <br />with many businesses wholesaling or doing Internet sales. The <br />Administrator agreed that a survey should be done, and suggested that this <br />matter be placed on the agenda for additional discussion once survey <br />results are completed. <br />VACANCY Blesener reported that there is a vacancy in the City Council office given <br />IN CITY the untimely passing of Council Member Jim LaValle. Blesener noted <br />COUNCIL that Council Member LaValle won re-election in the November General <br />OFFICE Election for an additional four year term through December of 2010. <br />The City Attorney reviewed his November 22"`~ report outlining the <br />Council's options relative to the vacancy. The City Clerk reported that <br />when Mayor Blesener was elected to the Office of Mayor at the 2004 <br />November Election, the Council conducted an appointment process to fill <br />the vacancy in Blesener's Council term. The Clerk noted that the vacancy <br />was advertised, applications taken, applications rated by the Council based <br />on rating method established by the City Administrator, and the top four <br />candidates were interviewed by the Council. As the result of that process, <br />Council Member Keis was appointed to fill the remainder of Blesener's <br />Council term of slightly less than two years. <br />16 <br />
