Little Canada Planning Commission <br />2 July 1987 <br />Page Two <br />As noted earlier, the lot is vacant, however, the applicant has been using this <br />parcel for lake access and has a dock and boat off of this portion of the lot with <br />permission of the Lepsche's. The Cocchiarella's are aware the lot is not buildable <br />and intended to use the lot for access to the .lake. <br />The subdivision request is also subject to the P..rkland Dedication requirement as <br />outlined in section 1007 of the subdivision ordinance. Taking into account <br />the size of the lots, a cash contribution would be more appropriate than a land <br />dedication. The cash contribution amount is to be etermined by the City. <br />Due to the fact this lot is in the Shoreland District the Minnesota Department <br />of Natural Resources (DNR) was contacted. The DNR has indicated that they would <br />discourage this request as access lots have created problems, not for the pro- <br />perty owner themself but for the surrounding property owners. One concern is <br />that property owners begin to split lots for lake access creating many unco- <br />ordinated access points which become an uncontrollable nuisance. <br />At issue in this request are major and significant concerns. The first is the <br />precedent of creating substandard lots with no justification per ordinance stan- <br />dards. The second issue, as reflected by the DNR's concern, is the creation and <br />expansion of private lake shore access by non - abutting properties. In this <br />regard, a major question arises relative to how small a lot' would be considered <br />acceptable should this request be approved. <br />RECOMMENDATION <br />Based on the above review and the minimum lot requirements for the subdivision of a <br />lot, our office cannot endorse a lot split and unjustified variance of a lot <br />that is already substandard.
