Minutes <br />Cocchiarella/ <br />Lepsche <br />Property <br />Division <br />MINUTES OF THE REGULAR MEETING <br />PLANNING COMMISSION <br />LITTLE CANADA, MINNESOTA <br />July 9, 1987 <br />Pursuant to due call and notice thereof a regular meeting of the <br />Planning Commission of the City of Little Canada, Minnesota was <br />held on the 9th day of July, 1987 in the Council Chambers of the <br />City Center located at 515 Little Canada Road in said City. <br />Chairman Peter Costa called the meeting to order at 7 :30 P.M. and <br />the following members were present at roll call: <br />MEMBERS PRESENT: Peter Costa, Chairman <br />Bill Davison <br />Art Herkenhoff <br />Thomas Perlinger <br />Peggy Schweizer <br />Sharon Timmons <br />Gene DeLonais <br />ALSO PRESENT: Steve Grittman, City Planner <br />Kathleen Glanzer, Recording Secretary <br />There being no corrections to the minutes of the June 11, 1987 <br />meeting, the Chairman declared the minutes to stand approved as read. <br />Mr. Mario Cocchiarella appeared before the Commission requesting <br />approval of the division of the Lepsche lakeshore property. Mr. <br />Cocchiarella reported that he will be purchasing a portion of this <br />property in order for him to have lakeshore rights. <br />Cocchiarella informed the Council that hips property is located on <br />Lakeshore Court and it was originally intended that his property was <br />to have lakeshore rights. However, due to a legal error in transferring <br />the property, lakeshore rights were not provided. <br />The City Planner pointed out that the DNR is concerned over the <br />division of lakeshore properties, as approval of the proposal before <br />the Commission would encourage other property owners to divide and <br />sell portions of their lakeshore. Thus, the potential for additional <br />docks is greatly increased. The Planner suggested that as an alternative, <br />Mr. Cocchiarella could negotiate an easement with Mr. Lepsche over a <br />portion of the lakeshore. If a private easement were negotiated, the <br />City would not be involved. The Planner pointed out that the easement <br />would be filed and recorded on the Cocchiarella deed, and if the <br />Cocchiarella's sold their property, the easement would run with the <br />land. The Planner suggested that an Attorney draft the easement, however. <br />The Commission discussed the proposal as well as the alternative as <br />suggested by the Planner, and felt that the easement would be the <br />best way for Mr. Cocchiarella to gain lake rights, noting that the <br />property division would probably not gain approval. <br />Page 1 <br />
