AMENDED PERMIT <br />FOR CONSTRUCTION AND OPERATION <br />OF A WASTE DISPOSAL FACILITY <br />Pursuant to and in accordance with Minnesota Statutes Chapters 115 and 116 and <br />Minnesota Pollution Control Agency (MPCA) Regulations SW 1 -12, and MPCA Rules <br />of Procedure 1 -13: <br />Frank M. Frattalone <br />3066 Spruce Street <br />St. Paul, Minnesota 55117 <br />is authorized by the MPCA to construct and operate the Frattalone Demolition <br />Landfill under the conditions set forth herein. The determination to issue <br />this permit is discretionary with the MPCA and was made subsequent to MPCA <br />staff review of the permit application. <br />PART I. CONSTRUCTION <br />A. Location. The location of the waste disposal facility authorized <br />by this permit shall be in Section 31, T3ON, R22W, Little Canada <br />Township, Ramsey County, Minnesota. <br />B. Facility Description. The facility assessed as being suitable as <br />a demolition landfill covers 13 acres. The capacity of the site is <br />130,000 cubic yards compacted in place of demolition waste and cover <br />material and the estimated life is one year. The site is not open <br />to the public and its use will be limited to F.M. Frattalone <br />Excavating and Grading Company only. <br />C. Plans and Specifications. The permittee shall construct the demo- <br />lition waste landfill project covered by this permit in accordance <br />with the permit application dated March 16, 1984, and plans received <br />March 21, 1984, which are attached hereto and incorporated herein. <br />The approval, by the MPCA, of the plans and specifications shall not <br />be construed to release the permittee from any present or subsequent <br />requirements of statute, rule, regulation, or ordinance. <br />D. Special Construction. The permittee shall divert all surface water <br />around the site. A new ponding area will be constructed on the <br />southwest side of the expansion area. The original permitted pond <br />will be filled with demolition waste to an elevation of 880. The <br />permittee shall avoid water ponding of diverted surface water on <br />all adjacent properties. The permittee shall control access by use <br />of fences or berms of soil. A lockable entrance gate shall be <br />installed by the permittee at the entrance road to the site. <br />PAGE -8 <br />
