This permit shall not release the permittee from any liability, <br />penalty, or duty imposed by Minnesota or federal statutes, or <br />regulations, or local ordinances including, but not limited to, <br />those promulgated pursuant to Minnesota Statutes Chapters 115, <br />116, 400, and 473. This permit shall be permissive only and shall <br />not be construed as estopping or limiting any claims against the <br />permittee, its agents, contractors, or assigns, nor as estopping <br />or limiting any legal claims of the state against the permittee, <br />its agents, contractors, or assigns for damages to state property, <br />or for any violation of the terms of this permit. <br />I. This permit authorizes the permittee to perform the activities <br />described herein under the conditions set forth. In issuing this <br />permit, the state /MPCA assumes no responsibility for any damage to <br />persons, property or the environment caused by the activities of <br />the permittee in the conduct of its actions, including those <br />activities authorized, directed or undertaken pursuant to this <br />permit. To the extent the state /MPCA may have any liability for <br />the activities of its employees, that liability is explicitly <br />limited to that provided in the Torts Claims Act, Minn. Stat. <br />§ 3.736 (1982). <br />J. This permit shall not prevent the future adoption by the MPCA of <br />any rule, regulation, standard, or order more stringent than those <br />now in existence or prevent the enforcement of such rule, regula- <br />tions, standard, or order against the permittee consistent with <br />procedural and substantive due process and other applicable <br />statutory and constitutional authority. <br />K. This permit is valid for five years from the date issued, or until <br />terminated, revoked, or amended by the MPCA. Prior to expiration <br />of this permit, or to apply for an amended permit the permittee <br />shall request that the MPCA review and reissue the permit.
