-4- <br />D. If the permittee elects to close the facility during the term of <br />this permit, closure of the facility shall proceed in accordance <br />with the above requirements. <br />PART IV. GENERAL CONDITIONS <br />A. The permittee shall construct and operate the disposal system in <br />accordance with the provisions of this permit and any applicable <br />statute, rule, regulation, standard, or order. <br />B. The permittee shall not knowingly make any false statement, repre- <br />sentation or certification in any record, report, plan, data, or <br />other document required to be submitted to the MPCA under this <br />permit. The permittee shall immediately upon discovery report to <br />the MPCA any errors in such reports, plans, or other documents. <br />C. The permittee shall allow the MPCA or any authorized employee or <br />agent of the MPCA to enter upon any property, owned or controlled <br />by the permittee, for the purposes of examining and copying <br />nonprivileged records, conducting inspections, surveys, investiga- <br />tions, monitoring, sampling, and otherwise obtaining necessary <br />information pertaining to the construction, operation, and <br />environmental effect of the disposal facility, control equipment <br />and control materials. <br />D. The permittee shall not assign or transfer this permit without <br />first obtaining the written approval of the MPCA. An unapproved <br />assignment or transfer shall render this permit null and void. <br />E. This permit may be modified or revoked in whole or in part during <br />its term for causes including, but not limited to: <br />1. Violation of any terms or conditions of this permit. <br />2. Obtaining this permit by misrepresentation or failure to <br />disclose fully all relevant facts. <br />F. The provisions of this permit are severable, and if any provision <br />of this permit, or the application of any provision of this permit <br />to any circumstance, is held invalid, the application of such pro- <br />vision to other circumstances, and the remainder of this permit <br />shall not be affected thereby. <br />G. The permittee may request an extension of the dates set forth in <br />this permit including the submittal and monitoring dates. The <br />request shall include justification for noncompliance with the <br />date. Based on the justification, the Director may grant an <br />extension. <br />PAGE -11 <br />
