A licensed residential facility serving six or <br />4 fewer parsons or a licensed day care facility serving 12 or <br />5 fewer persons shall be considered a permitted single family <br />6 residential use of oroperty for the purposes of zoning. <br />7 Subd. 4. Unless otherwise provided in any town, municipal <br />8 or county zoning regulation, a licensed residential facility <br />9 serving from seven through sixteen persons or a. licensed day <br />10 care facility serving from 13 through 16 persons shall be <br />11 considered a permitted multi - family residential use of property. <br />12 for purposes of zoning. A township, municipal or county zoning <br />13 authority may require a conditional use or special use permit in <br />14 order to assure proper maintenance and operation of a facility, <br />15 provided that no conditions shall be imposed on the facility <br />16 which are more restrictive than those imposed on other <br />17 conditional uses or special uses of residential property in the <br />18 same zones, unless such additional conditions are necessary to <br />19 protect the health and safety of the residents of the facility. <br />20 Nothing herein shall be construed to exclude or prohibit <br />21 residential or day care facilities from single family zones if <br />22 otherwise permitted by a local zoning regulation. <br />23 Subd. 5. Notwithstanding any law to the contrary, no <br />24 license or provisional license shall be issued under sections <br />PAGE -27 <br />
