I <br />will review the amendment of each section in this letter. <br />The amendment of Section 209.100(A) lists ten holidays for <br />City employees. Section 209.100(B) requires that an employee be <br />on active payroll status the day before and the day after a <br />holiday to be eligible for holiday pay. <br />Section 209.120(C) now allows the use of sick leave for the <br />employee's doctor and dentist appointments on a specified basis. <br />Section 209.120(D) has been amended to provide that only a <br />three (3) month absence from work shall be considered to still <br />remain in the municipal service. <br />Section 209.120(1) and Section 209.130(B) now allow for the <br />use of compensatory time for short absences. <br />Section 209.180 relating to retirement has been deleted in <br />its entirety. <br />Section 209.200(H)(6) provides that excessive garnishment <br />may be grounds for dismissal from the municipal service. Minn. <br />Stat. Section 571.61 provides that no employee may be discharged <br />by reason of the fact that the employee's earnings have been <br />subjected to garnishment or execution. It does not appear that <br />the legislature has explicitly dealt with the issue of whether <br />excessive garnishment can be grounds for discipline of an <br />employee. Since the answer to the question does not appear to <br />be clear, I will await further instruction from the Council <br />before any additional amendments of this section. <br />PAGE -28 <br />
