The issue of the use of Tax Increment Financing was left <br />unresolved at Council, as the Council members had reservations about City assistance with a <br />project of this scope and scale. It is our understanding that the developer is pursuing <br />development on additional property in an effort to make the project more attractive for tax <br />increment use. However, surrounding development would not affect the current proposal's <br />design. Therefore, the PUD is being pursued at this time. <br />ANALYSIS <br />At its 22 April meeting, the City Council approved the concept stage subject to: <br />• Recommendations in the NAC report of 2 April 1987. <br />o Recommendations of the City Engineer on drainage. <br />• Recommendations of the Park Commission on park dedication fees. <br />This report will review compliance with the 2 April planner's recommendations. <br />1. Compliance with CUP conditions of Section 912.040.0. <br />From this list, the following actions have been taken: <br />• The developer has requested an extension of operating hours beyond the 6:00 a.m. to <br />12:00 midnight limits. <br />• The developer proposes to move the southernmost curb access on Rice Street 10 feet <br />to the north, and has eliminated the third proposed Rice Street curb cut on the north. <br />• A loading /service space has been located adjacent to the south portion of the <br />convenience store. <br />• Parking supply has been reduced from 70 to 66 adjacent to the Retail Center, still in <br />excess of the 64 space requirement. <br />• Rubbish containers have been provided in two locations.
