LS'.;CF GRANTS MANUAL <br />CHAPTER 670.3 <br />K. Cost of Real Property Purchased from 0_her Public Agencies. The, <br />actual cost to the project' sponsor of land purchased from another <br />public agency may be eligible for matching assistance, subject to the <br />following conditions: <br />(1) The land was not originally acquired by the other agency for <br />recreation. <br />(2) The land has not been managed for recreational purposes while in ' <br />public ownership. <br />(3) No Federal assistance was provided ia.tihe original acquisition by <br />the other agency to facilitate the basic project being funded by <br />LSWCF assistance, unless the Federal assistance was provided by <br />the supplemental programs allowed in Section 670.1.5. <br />(4) The selling agency is required by law to receive payment for land <br />transferred to another public agency. Examples would be public <br />school land that can be used for non — school purposes only through <br />payment to the school agency, or excess State prison lands that <br />can be transferred to local government use only on a purchase <br />basis. The support ceiling will be based on the price paid by <br />the project sponsor for the property or the fair market value, <br />whichever is less. In some instances the selling agency may be <br />permitted a choice between various State laws which would set the <br />selling price at different levels depending upon which law is <br />chosen by the agency. For example, various laws may be in force <br />ftl which would allow the agency to transfer the real property to <br />zci another public agency for fair market value, for reimbursement of <br />unpaid taxes, as a donation, or for other consideration. L&WCF <br />assistance will be limited to the minimum amount for which the <br />'property could be transferred legally and only in those instances <br />for which there is an attorney. general's opinion or established <br />case law. <br />(5) The requirement of appraisal, history of conveyances, and <br />evidence of title are the same as normal purchases. <br />(6) If the selling agency is Federal, fair market value is paid (see <br />Section 670.3.5M). <br />L. Costs of Real Property Acquired through Exchanges. Land owned and <br />administered by the project sponsor may be exchanged for more <br />valuable land administered by another public agency or for land owned <br />by a private party. The support ceiling will be based on the amount <br />of cash, if arty, that must be paid by the project sponsor in addition <br />to the land conveyed, subject to appraisal requirements.
