MINUTES <br />Planning Commission <br />Dec. 10, 1987 <br />Van Guilder reside in the house, and operate an upholstery business out of the <br />Request garage existing on the property. VanGuilder reported that in a couple <br />(Cont.) of years he planned to construct a building on the property for his <br />business. VanGuilder reported that he does commercial upholstery as <br />well as re- upholstery of cars. <br />The City Planner reviewed his report recommending denial of the <br />request. The Planner noted that the Comprehensive Plan recommends <br />commercial uses along Little Canada Road. The Planner pointed out <br />that B -3 zoning requires a strictly commercial use of a property <br />with no combination of residential use, except for previously <br />grandfathered in residential uses. However, once these <br />residential uses cease, the property is required to be strictly <br />commercial. <br />The Planner pointed out that the applicant is requesting RB zoning <br />so that he can mix commercial and residential use. However, a <br />rezoning would be inconsistent with the Comprehensive Plan and <br />would constitute spot zoning. <br />DeLonais asked if there would be outdoor parking of vehicles on the <br />site. <br />VanGuilder replied that there is room for 4 vehicles inside the <br />building and could be 3 or 4 vehicles parked outside. <br />DeLonais pointed out that the City previously turned down the request <br />of Maaco Auto Painting to locate on Little Canada Road, and DeLonais <br />felt that situation was the same. DeLonais stated that he would like <br />to see Little Canada Road and County Road C kept clean. <br />Frank Durkin, representing Realty World, reported that he approached <br />the City about this proposal in October and was told that he needed <br />a minimum of 100 feet of frontage on Little Canada Road. Durkin reported <br />that the property has been surveyed and it appears there is slightly <br />more than 100 feet of frontage. <br />Durkin reported that VanGuilder wants to use this property as a stepping- <br />stone to another location in the next 3 to 5 years. Durkin reported <br />that the property will be very difficult to sell with its existing <br />zoning, noting that it will be impossible to obtain financing on the <br />property. <br />DeLonais pointed out that the request is spot- zoning and noted that <br />there is no hardship present to support the request. <br />Durkin reported that in talking with City staff he was of the impression <br />that the zoning was not a problem, but the fact that there are two <br />parcels involved and a problem with the legal descriptions on these <br />parcels. Durking reported that they have had the property surveyed <br />and some abstracting work done. <br />Page 2 <br />
