The proposed lots face onto Sylvan Street and are zoned R -1, <br />Single Family Residential District. Please refer to the attachments. <br />ISSUES AND ANALYSIS <br />The proposed combination and subdivision of lots 21 -29 would create a 20,250 square <br />foot lot and a 10,135 square foot lot. Both lots, one of which is a corner lot meet <br />the lot area and width requirements for interior and corner lots in the R -1 District. <br />As shown on attachment B a portion of lots 21 and 22 have been dedicated as a <br />permanent easement for cul -de -sac purposes. The applicant is also intending to <br />build a single family home on the northerly lot that contains the cul -de -sac ease- <br />ment. The applicant is requesting to build a single family home within the same <br />setback limits as before the cul -de -sac easement was dedicated. A variance is re- <br />quired to build closer to the easement than what is required. A variance can be <br />granted per ordinance Section 922.010 subdivision C., if special conditions or cir- <br />cumstances exist and that the special conditions or circumstances do not result <br />from the actions of the applicant. The governmental action has left the applicant <br />with less buildable area than what is required by ordinance therefore, it would <br />appear that the variance request to build at the setbacks outlined for R -1 Dis- <br />tricts is justified by allowing the applicant adequate area to build. <br />In the subdivision procedure the lots are also subject to 6 foot utility ease- <br />ments along all lot lines. These easements are required of all subdivisions un- <br />like the governmental action discussed previously. Each subdivision is also <br />subject to the Park Land Dedication Requirement.
