Their request stems from the placement of a single
family structure which encroaches on their property over the shared property line
with Lot 4. This report includes several exhibits which help to detail the history
of this request and illustrate the proposal. They are as follows:
Exhibit A
Exhibit B
Exhibit C
Exhibit D
Exhibit E
Exhibit F
Exhibit G
Exhibit H
Exhibit I
Half Section Map Location
Plat of Gervais Shores
Lot 4 Survey
Lot 5 Survey
Building Inspector's Memorandum
Lot 5 Building Layout
Attorney's Letter
Application
Letter to Appraiser
ANALYSIS
The house built by the owners of Lot 4 encroaches onto the Foyt's property by
approximately 9 feet. Staff has indicated that due to building codes, the City would
permit the Foyt's house to be built no closer than 6 feet from the encroaching structure.
The Foyts claim that this requires that their desired structure be moved to within
six feet of the north property line abutting Lot 6.
Page 44
4601 excelsior blvd., ste. 410, minneapolis, mn 55416 (612) 925 -9420
