MINUTES <br />CITY COUNCIL <br />APRIL 24, 2013 <br />DONOVAN <br />CONSTRUCTION <br />CONTINUED <br />USE <br />AGREEMENT <br />The City Administrator reported that Donovan Construction has <br />requested permission to use the site we purchased from them to stage a <br />construction project they have in the metro area. They would like to use <br />a building /restrooms and some outdoor storage. Donovan has offered to <br />pay for utilities, liability insurance, and a usage fee of $3,200. They may <br />need the site until the end of the year. The Administrator noted that the <br />City has no plans for the site at this time. He only concern was that he did <br />not want a rental situation to jeopardize the City's ability to claim tax <br />exempt status for this property in 2014. <br />The Administrator also reported that Q3 has asked if they can lease one of <br />the Donovan buildings for a couple of months for a fabrication project. <br />Q3 would also pay a rental fee and be responsible for liability insurance. <br />A specific rental amount has not yet been determined. <br />The Administrator asked for Council authorization to enter into lease <br />agreements with Donovan and Q3 subject to there being no negative <br />impact on the City's ability to claim tax exempt status on this property. <br />Blesener asked if there has been any other interest in the property. The <br />Administrator replied that there has not and indicate that any additional <br />proposals would be presented to the Council for review. Keis asked the <br />end dates for both users. The Administrator replied that those dates are <br />undetermined at this point, but indicated the end dates would be prior to <br />year end. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2013 -4 -72 — AUTHORIZING THE CITY <br />ADMINISTRATOR TO ENTER INTO INTERIM USE <br />AGREEMENTS WITH DONOVAN CONSTRUCTION AND Q3 AS <br />PRESENTED SUBJECT TO APPROVAL OF THE AGREEMENTS <br />BY THE CITY ATTORNEY, AND SUBJECT TO THE <br />AGREEMENTS NOT JEOPARDIZING THE CITY'S ABILITY TO <br />FILE FOR TAX EXEMPT STATUS FOR THIS PROPERTY FOR <br />2019 <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />17 <br />
