MINUTES <br />CITY COUNCIL <br />APRIL 24, 2013 <br />CABLE TV <br />PUBLIC <br />ACCESS <br />AWARD <br />VARIANCE — <br />790 LABORE <br />ROAD — <br />JAEDE <br />Montour announced that CTV 15 Public Access awarded Mary Jo Farrell, <br />Joy Kokaisel, and Sue Nelson their Hot Mic Award at their Annual <br />Banquet for their commentary work during the annual Canadian Days <br />Parade. <br />Mayor Blesener noted that at the March 27, 2013 Council meeting action <br />was tabled on an application for Variance to allow garage space over <br />1,500 square feet in size as requested by Chris Jaede pending a study by <br />the City Planner to determine similar regulations in surrounding <br />communities. Blesener noted that the report submitted by the Planner <br />indicates that the 1,500 square foot maximum for garage space is on the <br />high side compared to adjoining communities. <br />The City Planner reviewed his April 5th report noting the summary of <br />options that cities use to regulate garage and accessory building size. He <br />indicated that there is a wide range of maximum garage sizes from less <br />than 1,000 square feet to over 1,500 square feet in rural communities with <br />rural lot sizes. The Planner indicated that 1,500 square feet is on the high <br />end for metro cities. <br />Blesener noted that the Planning Commission had a split vote on the Jaede <br />Variance request. He also pointed out that the City Planner recommended <br />denial of the Variance as there were no unique conditions of the property <br />that would compel approval. The Planner noted that it is difficult to find <br />that there are practical difficulties in putting this property to a reasonable <br />use, or that any such difficulties are not created by the applicant. The <br />Planner stated that the Variance request was made solely on the <br />applicant's desire to construct a larger garage. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2013 -4 -61— DENYING THE VARIANCE TO <br />ALLOW GARAGE SPACE OVER 1,500 SQUARE FEET <br />REQUESTED BY CHRIS JAEDE, 790 LABORE ROAD, BASED ON <br />THE FINDINGS OF THE CITY PLANNER AS OUTLINED IN HIS <br />MARCH 8, 2013 REPORT THAT THERE ARE NO PRACTICAL <br />DIFFICULTIES IN PUTTING THIS PROPERTY TO A <br />REASONABLE USE WITHOUT THE VARIANCE <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />2 <br />
